In this brief addressed to Ms. France-Élaine Duranceau, Minister Responsible for Housing, Me Yves Joli-Cœur, President of the RGCQ, advocates for a more coherent application of Article 1068.1 of the Civil Code of Québec. He challenges the interpretation that the syndicate’s certificate on the condition of the co-ownership may only be issued after the signing of a promise to purchase. According to him, this reading goes against the spirit of the reform introduced by Bill 16, which aims to improve transparency in real estate transactions.
